Terms of sale

These terms are a translation of the French “Conditions générales de vente”, which prevail in case of difference.

1. Purpose

These terms of sale apply to all orders placed by consumers on the MISIR website. By confirming an order, the customer acknowledges having read and accepted them.

3. Products

The main characteristics of the products (description, composition, care, sizes) are shown on each product page. Photos are as accurate as possible; slight colour differences may occur depending on screens.

Some products are offered for pre-order (see article 6). Products marked “Coming soon” cannot be ordered: signing up to their waitlist only means being notified by email when they become available and does not commit to any purchase.

4. Prices

Prices are shown in euros, all taxes included. Shipping costs are shown before the order is confirmed. The price applied is the one displayed at the time of the order. For deliveries outside the European Union, customs duties or local taxes may be due (see article 8).

5. Ordering

The customer selects their items, enters their details, chooses a shipping method and proceeds to payment. Before paying, they can check the details and total price of their order and correct any errors. The order is confirmed by a summary email. MISIR may refuse or cancel an order in the event of an existing dispute with the customer or suspected fraud.

6. Pre-orders

For a pre-order item, payment is made when ordering. The item is produced after the pre-order period and delivered no later than 30 days after the order, unless another date is given to the customer before purchase. In the event of a delay, the customer is informed by email; if the deadline is not met, they may request the cancellation of their order and a full refund of the amounts paid, under the conditions of articles L216-6 and following of the French Consumer Code.

7. Payment

Payment is made online, securely, by bank card or by the other methods offered at checkout. The amount is charged when the order is confirmed. MISIR never has access to the customer's full bank details.

8. Delivery

Orders are delivered to the address given by the customer, in France, in the European Union and in the other countries listed on our Shipping page, which also details shipping rates. For deliveries outside the European Union, import duties and taxes may be charged by the destination country; they are not included in the prices and are paid by the customer. The customer checks the parcel on receipt and reports any problem to MISIR as soon as possible. The risk of loss or damage passes to the customer when they take physical possession of the products.

9. Right of withdrawal

The customer has 14 days from receiving their order to withdraw, without giving any reason. They inform MISIR of their decision by email at contact.misir@gmail.com or using the form in the appendix, then send the items back no later than 14 days after this notification, to: MISIR, 41 Rue du Sabot, 21130 Auxonne, France.

Return costs are paid by the customer. Items must be returned complete and in their original condition: the customer may try them on, but may be held liable for any loss in value resulting from other handling.

MISIR refunds all amounts paid, including the original shipping costs (up to the standard shipping rate for the customer's country), within 14 days of receiving the withdrawal request. This refund may be held back until the items are received or until the customer has provided proof of postage. It is made using the payment method used for the order. 10. Legal guarantees

All products are covered by the legal guarantee of conformity (articles L217-3 and following of the French Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the French Civil Code).

  • Legal guarantee of conformity: the customer has two years from delivery to act. They may request the repair or replacement of the product and, if this is impossible, a price reduction or the cancellation of the sale. During this period, they do not have to prove that the defect existed at the time of delivery.
  • Guarantee against hidden defects: the customer may act within two years of discovering the defect and choose between cancelling the sale and a price reduction.

11. Customer service and complaints

12. Personal data

The data collected when ordering is needed to process the order. How it is used is described in our privacy policy.

13. Intellectual property

The texts, photos, logos and designs on the website belong to MISIR. Any reproduction without permission is prohibited.

14. Applicable law

These terms are governed by French law. This does not deprive the customer of the protection granted by the mandatory provisions of the law of their country of residence.
